Terms & Conditions

The following terms and conditions apply to all holidays booked with Oysters & Pearls Private Limited trading as Oysters & Pearls (“we”, “us” or “our”), registered in Singapore under the company registration number 201803508C. In these terms and conditions, “you” and “your” apply to all persons named in the booking, including anyone added or substituted at a later date. Please read the following carefully as it forms the basis of your contract with us once your deposit has been made.

1.   BOOKING & PAYMENT

  • To book a holiday, please get in touch with us via email or the website to request a quotation. An outline of your proposal and preliminary costing will be prepared and sent to you. A non-refundable planning fee will be requested in order to move forward with an in-depth and detailed proposal. Should you proceed to confirm the trip with us, the planning fee will go towards offsetting the cost of the trip.

  • Once you are satisfied with the quotation, you should then return a signed and completed booking form to us with the non-refundable deposit. The lead client whose name is listed on the booking form accepts these terms and conditions on behalf of all members of the party and confirms that he/she is so authorized to do so by all other members of the party. The lead client is responsible for payments due to us and must be at least 18 years of age.

  • Only upon receipt of a deposit payment - 30% of the total cost of the trip – will your reservations be made and arrangements confirmed. Full payment of the trip must be received no less than 10 weeks of the arrival date unless otherwise stated. Bookings made less than 10 weeks to departure require full payment upon confirmation.

  • Upon receipt of the deposit, a written confirmation will be issued by us. At which point, a binding contract is formed between us. We will then need to confirm all the components of your holiday booking, which can take up to several weeks. A confirmation invoice will be sent to you which will include details of the balance payment.

  • Exchange rates are derived from the bank’s transactional rate and is subject to currency fluctuations. We will always quote the price of your holiday by reference to the base currency in which the booking would be made by us, on the date that the quotation is created. If an adverse currency fluctuation occurs, equal to 2% or more of the overall price during the period between the date of the quotation and the date(s) for payment of the deposit and/or final balance payment for the holiday, we reserve the right to adjust the final balance payment due to reflect such currency fluctuation.

 

2.   ALTERATIONS & CANCELLATIONS BY YOU

  • Should you wish to make an alteration to the dates or other details of your confirmed booking, we will do our best to make the changes but cannot guarantee that your request will be met. If the requested changes are able to be made, we will detail any additional costs incurred by ourselves or any costs imposed by our suppliers, along with an amendment fee of SGD100 per person.

  • Cancellations must be notified to us by the lead client in writing. Only upon receiving written notice of your cancellation at our email contact will the cancellation be effective. In all cases, your deposit is non-refundable. If you cancel within 10 weeks of departure, 50% of your holiday price is due. If you cancel within 1 week of departure, the full price of your holiday is due. 

  • Kindly note that in the event that the cancellation charges of the suppliers we use are more than ours, then the suppliers’ cancellation terms will apply.

  • If a member of your travelling party is unable to travel, you may wish to substitute someone else you know in his/her place. This is provided the transfer of names/rebooking is accepted by third party suppliers.

 

3.   ALTERATIONS & CANCELLATIONS BY US

  • In the unlikely event that changes have to be applied to your booking, we will inform you as soon as possible. While we will do our best to deliver the holiday we are contracted to provide, on occasions, the arrangements that we have had to make months beforehand may need to be changed and we must reserve the right to do so.  

  • Most changes will be minor and you will be informed of them as soon as possible. In the event of a major change, which may include significant price increases, change of your city/resort/place of destination, or change of your accommodation to a lower grade. If we make a major change to your holiday we will inform you as soon as possible. You will then have the choice of:

(i)      accepting the changes (for significant changes) or
(ii)     purchasing an alternative holiday from us, of a similar standard to that originally booked
(iii)    cancelling or accepting the cancellation and receiving a full refund of all monies due.

 

4.   OUR LIABILITY

  • We accept responsibility for our suppliers and local representatives, provided that our suppliers and representatives have acted within our authority and in accordance with our instructions at all times. We do not accept responsibility for travel by air, sea, rail or the provision of accommodation.

  • We do not accept responsibility for any indirect or consequential loss whatsoever arising under or in connection with our provision of your holiday.

  • We do not accept responsibility for any injury, illness, death, loss (e.g. loss of enjoyment, damage, expense, cost or other claims or liability of any description whatsoever which results from any of the following: (i) any fault of you or any member of your party, (ii) any fault of any third party unconnected with us and the provision of the services for which you have contracted with us; (ii) any force majeure circumstances which are beyond our or our suppliers’ reasonable control. 

  • We do not accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised by us and we have not agreed to arrange them as part of our contract and any excursion you purchase in resort.

 

5.   YOUR RESPONSIBILITY

  • When you book a holiday with us, you acknowledge that the nature of travel is unpredictable and that some holidays may involve personal risk. Some activities incidental to the holiday may carry inherent risks and if you wish to participate you may be requested to sign an additional waiver form by the local supplier.

  • Every traveler participates at his/her own risk of loss or injury to person and belongings. We shall not be responsible or liable for any loss, damage, expense, injury or death whatsoever including but not limited to such arising, occurring, suffered or sustained directly or indirectly from any of the following during or in connection with the tour: (a) any delay, accident, mechanical or electrical breakdown, sickness, weather condition, strike, crime, illegal act or omission, act of hostility, terrorism, conflict, war, quarantine or natural disasters; or (b) the denial of any traveler to board any aircraft or coach, or in the event any traveler is deported or refused entry to any country or place by any immigration or other authority or for and on behalf of any entity for any reason whatsoever; or (c) any act, omission, default or neglect of us whatsoever. The Company will not be responsible for the care of infants, children, elderly and handicapped participants. We reserve the right to politely refuse such

    participants should they be deemed be incompatible with the group and/or as instructed by the tour organizer. We are only acting as an agent and will not be held responsible for any changes, acts of discretion or inconvenience caused by our suppliers and appointed agents. In no case shall we or their employees or agents be liable for any causes outside their

    reasonable control or from any act of omission of the customer.

  • Your responsibility is to ensure that you are physically fit enough to participate, that you have adequate protective clothing and safety equipment and take sensible precautions for your own safety and for the safety of any children for whom you are responsible.

  • You must ensure that you and your travelling party have valid passports with at least 6 months’ validity beyond the date of return, and the appropriate visas and vaccinations.

6.   INSURANCE

  • We strongly recommend that you purchase a comprehensive travel package including trip cancellation protection and emergency medical evacuation, to protect against unforeseen circumstances that may spoil your travels. We strongly recommend cover for personal belongings, personal liability, and cancellations.

  • We will not be held responsible for any expenses; loss or damage you incur as a result of your failure to comply with this clause or the requirements of your travel insurance policy. Please ensure you read the conditions of your insurance policy carefully.

7.   YOUR INDEMNITY TO THE COMPANY

When you book a tour with us, you agree to fully indemnify us forthwith upon request from and against all actions, proceedings, claims and demands whatsoever which may be instituted or made against us, including but not limited to those for damages, other relief, interest (as well after as before any judgment), costs (on an indemnity basis) and expenses whatsoever and howsoever directly or indirectly occurring to, suffered or sustained by or relating to any person, entity, authority or property wheresoever situated, as a result of any act or omission (whether negligent or not) of yours during or in connection with the tour.

8.   EMERGENCIES

Should problems arise you are on your holiday, please contact the manager of the hotel or our local travel partner in the country. It is preferable to resolve the problem at source where possible. If this does not resolve the problem, please contact the Oysters & Pearls emergency number in Singapore.

9.   DATA PROTECTION & USE OF PERSONAL DATA

We respect your privacy and will make the necessary security arrangements to safeguard your personal information. It is our practice not to ask for information unless we need and/or intend to use it. The primary purpose for collecting your personal information is to provide and deliver our products and services to you; improving our service and to conduct research and analysis and advertising and marketing our products and services (“the purposes”).

The type of personal information that we collect includes but is not limited to; your name, home and email addresses, home/office and mobile numbers; date of birth; gender, passport number and details, marital status, occupation, nationality, and other information necessary to fulfil specific travel and tour related purposes (such as booking air tickets and accommodations, visa application, emergency contact purposes etc.)

When you provide us with personal information for the purpose of receiving any form of assistance from us, we will collect, use and/or disclose such personal information solely to facilitate providing such assistance. Personal data collected will not be given to third parties unless it is necessary to fulfil the purposes set out herein (eg. to share your information with vendors like hotels, airlines, land operators etc.) We will within our means to ensure that these third parties are also under similar obligations to protect your personal information.

We may amend this Privacy Policy from time to time. This Privacy Policy is not intended to, nor does it create, any contractual rights whatsoever or any other legal rights, nor does it create any obligations on us in respect of any other party or on behalf of any party.

10.   GOVERNING LAW

These terms and conditions and any disputes arising from them shall be governed by Singapore law. You and we agree to submit to the exclusive jurisdiction of the courts of Singapore regarding any such dispute.
